When a user sends a message, it hops from one device to another within Bluetooth range, creating a chain of communication. The takedown order was issued under Section 79(3)(b) of the Information Technology Act, 2000, read with Rule 3(1)(d) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Section 79 of the IT Act provides a “safe harbour” to intermediaries such as GitHub. This means an intermediary is not held liable for third-party content hosted on its platform, as long as it fulfils certain conditions.
